Terms And Conditions

The general terms and conditions of sale detailed below only govern the contractual relationship between the User (hereafter referred to as You) and Indigo Bird (hereafter referred to as We) belonging to the company TechPlaza EU VAT Number PT507924320 :


General

The prices indicated on the Site are in Euros and include all taxes but do not include delivery. The chosen possible delivery costs are indicated for the User during the product selection and are invoiced at the end of the order in addition to the price of the products.

We reserve the right to modify our prices at any moment.

We would like to inform you that if an obviously incorrect price appears on our website (a price that is clearly too low, for example), and for whatever reason (IT bug, human error, technical error etc.), your order will be cancelled, even if it has been initially validated.


Payment

Indigo Bird offers 3 methods of payment depending on the product purchased:

  • Bank Transfer

  • PayPal

  • Credit Card

    For payments made on-line by credit card the "Secure Socket Layer"(SSL) is used, which allows your banking information to be encrypted when on the network.
    Indigo Bird don't have access to your credit card number.


Ordering

We reserve the right to cancel an order totally or partially. The User will be informed by email about the reasons for cancelling the order.

If the User is absent at the time of delivery, the carrier will leave a note giving them details of how to collect the parcel themselves, or informing them of when another delivery will be attempted.

If the carrier is unable to deliver the merchandise for reasons related to the buyer (absence, incorrect address, etc.) Indigo Bird shall not be held responsible for the delay in delivery.

Items are transported at the buyer's expense and risk, and charges are applied if the User does not claim the parcel and it is returned to Indigo Bird.

Items are subject to availability. In case of unavailability the buyer will be notified by email as soon as possible and the order is immediately cancelled, unless the buyer agrees with the new delivery date or accepts the nearest match in colour, price or specs to the ordered product.

Upon reception of your order, we recommend that you verify your products with the order that you placed with us and if necessary, write any anomalies that may have occurred on the delivery voucher, not forgetting to sign it. Please note that we cannot accept any claims regarding incomplete orders or damaged items if not claimed within 24h after delivery date.

Please note that all countries outside the European Union Community may have customs fees and taxes applicable for clearance, which differ from country to country and which we are not aware of.

All these fees are at the customer's expenses. If the customer declines the merchandise reimbursement will not take place. Instead for retrieving the goods the customer shall pay another dispatch.

Any order shipment delay that may occur in regard to the Shipping date displayed, does not entitle the customer to any compensation.

Any offers or gifts associated with a product ordered will always be subject to stock confirmation and may be canceled without previous notice.


Returns

For any returned package, please contact us by e-mail (info@indigobird.eu) or phone + 351 21 0101 013 / (+44) 741 847 1781 and wait for the instructions for returning your products.
Indigo Bird allows you 14 days to return a product that you are not satisfied with. Your right of retraction starts from the moment your order is delivered. You can return the product within this time frame, at your own expense, with your invoice.

We request that you send us the merchandise by registered post and that you purchase insurance with the carrier for the value of the merchandise. This is necessary should they lose or damage the goods. Shipping fees remain the customer’s responsibility. The present right of return only applies to products that are returned in their original, complete working condition (packaging, accessories, user guide etc.). Any product that has been damaged, is not in its original packaging, has packaging that has been worn beyond simply opening the product, will not be refunded. Please note that the right of retraction does not apply to unsealed CDs, DVDs, and computer software also sealed products that may not be returned for health or hygiene reasons, which were unsealed by the customer after delivery.

The client will be reimbursed via the same payment method as was used initially. Indigo Bird will do its best to reimburse the client as quickly as possible for a maximum period of 20 days.

Please note that shipping fees are the client’s responsibility.


Litigation and responsibility

Indigo Bird will not be held liable for poor use and its consequences on the products purchased from our site.

In case of legal dispute, in the interpretation or application of these conditions, the court of the district of Lisbon, Portugal has jurisdiction, with express waiver of any other.
Please be advised that it is at the customer's disposal an EU alternative dispute resolution mechanism available through this link.


Warranties

The legal guarantee concerning product conformity covers all latent defects discovered within 2 years from the date your product was delivered. The Warranty period may change without previous notice by the manufacturer unilaterally and according to the kind of article and its purpose (i.e Professional use may grant a one-year warranty period whenever is determined by the manufacturer).

The legal guarantee concerning product conformity does not apply in some cases:

  • when damage is caused by external factors such as shocks, lightning, power surges, rust and sand.

  • when damage is caused by the customer’s non-respect of the manufacturer’s instructions regarding the use and installation of the product.

  • when damage is caused by the customer’s misuse of the product.
